Eligibility: The KOA Take a Spin-to-Win Giveaway (“Promotion”) is open only to legal residents of the United States and the District of Columbia (excluding Hawaii and Alaska) and Canada (excluding Quebec), who are 18 years of age or older and located in the U.S. or Canada at the time of entry. Void elsewhere and where prohibited by law. Employees, contractors, directors and officers of Kampgrounds of America, Inc. (“Sponsor”), Sponsor franchisees, Keystone RV Company and their respective parent companies, subsidiaries and affiliated companies, distributors and licensees, and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of the Promotion (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible to enter or win. Other eligibility requirements and conditions of participation are set forth below in these official rules for the Promotion (“Official Rules”).
Promotion Period: Promotion begins at 12 noon Mountain Time on April 18, 2014 and ends at 11:59 p.m. Mountain Time on September 14, 2014 (“Promotion Period”). The entry periods are as follows (each an “Entry Period”):
Entry Period 1: April 18 – July 6, 2014
Entry Period 2: July 7 – September 14, 2014
How to Enter the Sweepstakes: There are two ways to enter the Sweepstakes (collectively “Sweepstakes Entries”):
Sweepstakes Daily Entry. During the Promotion Period, enter the Sweepstakes by completing the following steps (“Sweepstakes Daily Entry”): Visit koaspintowin.com or the promotion application on the KOA page on Facebook, facebook.com/koakampgrounds (the “Websites”). In order to be able to enter the Promotion on Facebook, potential entrants must first “Like” the KOA Facebook page, if they have not already done so, and click on the link to locate the online official entry form. Follow the on-screen directions to enter the Sweepstakes. LIMIT ONE (1) SWEEPSTAKES DAILY ENTRY PER PERSON/EMAIL ADDRESS/DAY.
Sweepstakes Share Entry. During the Promotion Period, earn additional Sweepstakes Entries by sharing the promotion on Facebook or Twitter (a “Share”). You will receive three (3) entries into the sweepstakes drawing for each person that enters via the link in your Share. You will receive three (3) additional Sweepstakes Share entries: a) only once per referred friend; b) only the first time your friend successfully enters the Promotion; c) only if your friend has not previously entered the Promotion; and d) only if your friend enters the promotion immediately after clicking on the link contained in your Share. You may only refer persons with whom you have an existing personal relationship and with whom a message from you would not be considered spam. THERE IS NO LIMIT TO THE NUMBER OF SWEEPSTAKES SHARE ENTRIES PER PERSON.
Sweepstakes Game Entry. During the Promotion Period, earn up to three (3) additional Sweepstakes Entries by playing the Take A Spin game. You also earn the same number of entries as found on the number of the panel where your “spin” lands.
Grand Prize Drawings: On or about one week after each Entry Period ends, in San Jose, California, the Judging Agency will conduct a random drawing from among all eligible entries received during the applicable Entry Period. Entries from Entry Period 1 will not rollover into Entry Period 2.
Prizes and Approximate Retail Values (“ARV”) & Odds: 2 Grand Prizes:
Entry Period 1 Grand Prize: Keystone Passport 238ML (ARV $17,400) & Weber Grill Package (ARV: $500)
Entry Period 2 Grand Prize: Keystone Hideout 210HS (ARV: $17,700) & Weber Grill Package (ARV: $500).
Total ARV of Grand Prizes is up to $36,100. No substitution, cash redemption or transfer of prize is permitted except at Sponsor’s sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state and local taxes, and all other costs associated with acceptance or use of either prize are the sole responsibility of the winner. Arrangements for delivery of the prizes will be performed after winner validation. Odds of winning depend on the number of entries received. At Sponsor’s discretion, an unclaimed prize may not be awarded.
Conditions: Judging Agency decisions are final in all matters relating to this Promotion. Potential winners (and/or their parent/legal guardian if a minor) will be notified by telephone, email, regular mail or overnight mail, and may be required to complete, sign and return an affidavit or declaration of eligibility, a liability release, and where lawful, a publicity release within a stated amount of time. If releases are not received by the date stated on the notification, or if any notification is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, or does not return such other releases as deemed necessary by Judging Agency, the potential winner(s) will be disqualified and at Judging Agency’s discretion, alternative potential winner(s) may be selected. Promotion Parties are not responsible for any change of email address, mailing address and/or telephone number of entrants. Promotion Parties assume no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged or incomplete entries or other communications, non-delivered or postage due mail, failure or unavailability of electronic equipment, communications or internet connections, or other errors, failures or malfunctions of any kind. Entries by automatic, programmed or like methods will be disqualified. Improper, incomplete, mutilated and illegible entries will be disqualified. The Grand Prizes will be awarded only to winner(s) having an address within the United States or Canada, excluding Hawaii, Alaska and Quebec. This Promotion is subject to all federal and state laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Judging Agency, which shall be final in all matters relating to the Promotion. If, in Judging Agency’s sole opinion, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Judging Agency reserves the right to modify or terminate the Promotion in a manner deemed reasonable by the Judging Agency, at the Judging Agency’s sole discretion. In the event of cancellation of the Promotion, Judging Agency will randomly award the prizes from among all eligible, non-suspect entries received prior to cancellation. Judging Agency reserves the right to disqualify any individual who tampers with the entry process or the Websites or acts in a disruptive manner. This Promotion is offered only in the United States (excluding Hawaii and Alaska) and the District of Columbia and Canada (excluding Quebec) and all entrants agree that the rules shall be governed by the laws of Montana. By entering, entrants consent to the jurisdiction and venue of the state district court located in Yellowstone County, Montana.
Canadian residents must correctly answer a time-limited, mathematical skill-testing question (without assistance of any kind, mechanical or otherwise) if selected as a potential winner, in order to claim a prize.
The personal information collected through this Promotion is subject to Sponsor’s Privacy Policy located at http://koa.com/privacy/. By entering this Promotion, you agree to the use of your personal information as described in the above Privacy Policy.
As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Promotion Parties, their affiliates, subsidiaries, retailers, sales representatives, distributors, dealers, advertising and promotion agencies and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize; (b) to waive all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) that all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) that any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
Release: Except where prohibited, by accepting a prize, winner grants permission for Sponsor and its agents to use his/her name, video/photograph, voice and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
