CONTEST OFFICIAL RULES AND REGULATIONS
1. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrant is providing information to Canadian Ice Cream Company Inc. (“Sponsor”) and not to Facebook. The information the entrants provide will only be used for verification of eligibility to participate in the Contest. Please direct any questions or comments regarding this photo contest to [email protected].
2. THE CONTEST AND THE CONTEST PERIOD
The Unlimited Mixin Photo contest (the “Contest”) commences at 12:01 a.m. MST on May 12th, 2014 and concludes at 11:59 p.m. MST on June 9th, 2014 (the “Contest Period”).
3. NO PURCHASE NECESSARY
4. ELIGIBITY
Contest is open to legal residents of Canada (excluding residents of Quebec) who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Canadian Ice Cream Company Inc. (the “Sponsor”), its affiliated companies, franchisees, and any entity involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”).
By entering this Contest, you are agreeing to abide by and be legally bound by these Official Rules and Regulations (the “Rules”). If you do not agree to be legally bound by these Rules, then please do not participate in this Contest.
5. HOW TO ENTER
NO PURCHASE NECESSARY. Entrants can participate in this Contest via 3 methods of entry, outlined below. The number of entries per entrant is not limited. The maximum file size our photo contest supports is 50MB. Users can upload JPG, PNG, and GIF files to the contest. Submissions of previous contesting winning photos through a Canadian Ice Cream Company, Inc. contest are not permitted and are void if entered.
Facebook
To enter, go to https://www.facebook.com/MarbleSlabCanada (the “Facebook”)
and follow the on-screen instructions to log-in to your Account and: (i) click on the “Unlimited Mixin Photo Contest” tab; (ii) “Like” the fanpage (the “Fanpage”) (Note: only required if you are not already a fan of the Fanpage); (iii) Fully complete the Contest Form (the “Form”) with all required information, which requires you to: upload your photo and enter your first name, last name, valid email address, birthday; and (v) hit the “Enter” button; (vi) allow the Contest Application (the “Application”).
Twitter & Instagram
To enter, post a picture that complies with contest rules and regulations, and include #unltdmixincontest in the Tweet or Instagram post to be entered into the contest.
6. VOTING
Voting occurs on the Marble Slab Creamery Canada Facebook page. You must be a member of Facebook to participate in the voting process. Each Facebook user is permitted one vote per day, on a photo of their choice.
Marble Slab Creamery Canada and Canadian Ice Cream Company Inc. do not condone the use of artificial and other means contestants may use to inflate their vote totals, including but not limited to, vote farming and offering inducements for votes. Marble Slab Creamery Canada and Canadian Ice Cream Company Inc. have sole discretion to determine what constitutes inappropriate vote-inflating methods, and has the right upon determination of such behaviour to remove the individual’s entry and ban the individual from participating as an entrant in the remainder of the contest.
7. THE PRIZE
There will be 7 prizes: 1 Grand Prize of Ice Cream for a Year (valued as a $250 Marble Slab Gift Card); and 6 Sweet Prizes of $25 Marble Slab Gift Cards (the “Prize”). Prize will be administered via declaration and release letter consisting of complete prize details.
8. WINNER SELECTION AND NOTIFICATION
Winner selection for the promotion will be conducted by assigning the 6 Prizes randomly by draw Friday, May 16 2014, Friday, May 23, 2014, Friday, May 30, 2014 and Friday, June 6, 2014. The photo with the most votes will be our Grand Prize Winner and will be announced and contacted on Friday, June 13, 2014. Any potential winner will be notified by email, phone, Facebook, Twitter and/or Instagram, based predominantly on original method of entry. If a potential winner: (i) does not contact the Sponsor with their email and shipping address; (ii) does not respond within three (3) days from the date the Sponsor first tries to notify him/her; (iii) fails to return a Release; (iv) refuses the prize; and/or (v) the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the Promotion or receive the prize, and an alternate potential winner may be selected. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a “winner” of the Promotion.
9. LIMITATION ON NUMBER OF ENTRIES PERMITTED
Only one entry per entry method is permitted. Multiple entries will be discarded. Entries are subject to verification and will be declared invalid if they are reproduced, falsified, altered or tampered with in any way.
10. ODDS OF WINNING
The odds of winning this Contest depend on the number of eligible entries received.
11. DECLARATION AND RELEASE OF PRIZE WINNER
Before being awarded the Prize, the Prize Winner must:
1. Correctly answer, unaided, a time-limited skill-testing mathematical question; and
2. Sign a standard form confirming that by entering the Contest the Prize Winner:
a) accept(s) the Contest Prize as awarded;
b) for myself (or, in the case of a Parent/Guardian, for the Selected Entrant), my (or, in the case of a Parent/Guardian, the Selected Entrant’s) heirs, executors, administrators, assigns and personal representatives (collectively the “Releasors”) waive and release any and all claims to which I (or, in the case of a Parent/Guardian, the Selected Entrant) may become entitled to for any reason whatsoever including, without limitation, for death, personal injury, illness, breach of contract, negligence, strict product liability, economic loss or damage to person or property, and do hereby release, remise and forever discharge Canadian Ice Cream Company Inc. and their respective parents, subsidiaries, affiliates, predecessors, successors, assigns, related entities, partners, partnerships, licensees, licensors, service providers, advertising agencies, promotional agencies, fulfillment house, officers, directors, shareholders, governors, employees, volunteers, agents, and representatives (collectively the “Releasees”), of and from any and all liability, actions, causes of action, suits, debts, dues, sums of money, costs, interest, claims and demands whatsoever, whether at law or in equity, which I have (or, in the case of a Parent/Guardian, the Selected Entrant has) or hereafter may or shall have in connection with the Contest, my (or, in the case of a Parent/Guardian, the Selected Entrant’s) participation therein, any advertising or promotion related to the Contest, and my (or, in the case of a Parent/Guardian, the Selected Entrant’s) acceptance, possession, or use of the Contest Prize or any portion thereof;
c) declare and agree that I will not commence any proceedings with respect to the Contest, my participation therein, any advertising or promotion related to the Contest, or my acceptance, possession, or use of the Contest Prize against any other person or legal entity who may claim contribution or indemnity from the Releasees;
d) consent to the publication, reproduction dissemination and/or other use of my name, address, photograph, likeness, sobriquet, voice, personal information and/or statements about the Contest without further notice or compensation, in any publicity or advertisement carried out by the Releasees in any manner whatsoever, including print, broadcast, the internet and in-store marketing campaigns (the “Advertising”);
e) acknowledge that the product of the Advertising, including but not limited to photographs, negatives, positives, video or audiotapes, electronic files and prints to be generated by the Releasees (collectively the “Works”) may involve or include me and I hereby accordingly agree(s) to release all rights, including all moral rights, title and interest that I may have in the Works. I further agree(s) that all such Works shall become the property of the Releasees to be used as the Releasees see fit; and
f) declare that:
i. I have read, understood and agreed to the terms of this Declaration and Release, and am aware that this is a legally binding document that limits my rights;
ii. Neither I, nor any person with whom I reside(s) is an employee of Canadian Ice Cream Company Inc.
12. PRIZE TO BE ACCEPTED AS AWARDED
The random assignment of Prizes, and top voted Grand Prize selection is final, and the Prize must be accepted as awarded. No portion of the Prize is transferable. The Prize is not redeemable for cash and no substitute for any portion of the Prize is offered. Should the Prize winner be unable to claim the Prize as awarded, his or her entry will be forfeited and another eligible Contest entrant will be selected.
13. NO REPRESENTATIONS OR WARRANTIES
Sponsor does not make any representation or offers any warranty, express or implied, as to the quality or fitness of the Prize. The Prize winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from Sponsor should the Prize fail to be fit for its purpose or is in any other way unsatisfactory to the Prize winner.
14. OWNERSHIP OF ENTRIES
All entries shall become the property of Canadian Ice Cream Company Inc., the Sponsor(s) and their advertising and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed or otherwise indecipherable entries due to any failure or technical malfunction of the telephone network, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, and failure of any email or submission or due to any other reason regardless of cause.

16. COMPLIANCE WITH CONTEST RULES
All contestants agree to abide by the Contest Rules, which are subject to change at the sole discretion of the Sponsor(s).
17. COMPLIANCE WITH LAWS
This Contest is void where prohibited by law and is subject to all federal, provincial, territorial and municipal laws and regulations of Canada and of each province, territory and municipality of Canada, respectively.
18. PRIVACY
All entrant information collected, including email addresses, is subject to the respective Privacy Policy of the applicable Sponsor. Sponsor will never share your information with a third-party outside of Marble Slab Creamery. We do not sell, share, trade or disclose any information to any third party. |
