PROMOTION PERIOD: ON-THE-GO GIVEAWAY! ("Promotion") begins at 12:00:01 AM PST on Thursday, September 11, 2014 and ends at 11:59:59 PM EST on Thursday, September 25, 2014 ("Promotion Period"). All Submissions must be received during the Promotion Period.
ELIGIBILITY: This Promotion is open only to legal residents of the fifty (50) United States of America, the District of Columbia, and the ten (10) provinces of Canada who are eighteen (18) years of age or older at time of entry (each a "Participant" and collectively the "Participants"). Residents of Guam, Puerto Rico and all other U.S. possessions and Canadian territories are not eligible to enter this Promotion. Void where prohibited or restricted by law. Employees of Velcro Industries ("Velcro"), Breakaway Innovation Group., and their respective parents, subsidiaries, affiliates, and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are not eligible to enter, receive or participate in this Promotion.
HOW TO PARTICIPATE: To participate in this Promotion, a Participant is required to "Like" Velcro Brand Facebook page (facebook.com/velcrobrand) and enter a valid email address during the Promotion Period.
HOW TO RECEIVE THE GIVEAWAY: Recipients will be selected in a random drawing on or about September 25, 2014 from among all eligible Submissions received during the Promotion Period (each a "Recipient" and collectively the "Recipients"). Recipients will be announced on Velcro Brand Facebook page once all Recipients have been notified. The drawing will be conducted by Velcro Industries, whose decision is final on any and all matters relating to the Promotion. Odds of being selected are dependent upon the number of eligible Submissions received during the Promotion Period. The Giveaway will be given, and the Recipients will be notified via email or any other method in Velcro’s sole discretion. If a Recipient is disqualified or Velcro is unable to contact a Recipient within six (6) days from initial notification, he/she may be disqualified, and Velcro reserves the right to determine an alternate Recipient from the remaining eligible Participants, in its sole discretion. Unclaimed Giveaways will not be awarded. Velcro is not responsible for any change of email address or Facebook account status by any Participants and/or potential Recipients. Velcro is not responsible for and shall not be liable for late, misdirected, or unsuccessful efforts to notify potential Recipients. Receiving the Giveaway is contingent upon Participant's fulfillment of all requirements set forth in these Official Rules.
THE GIVEAWAY DELIVERY: One (1) recipient will receive one (1) $100.00 Michael's Gift Card and one (1) grab bag of VELCRO® Brand products. No transfer, substitution or cash equivalent permitted by any Recipient.
Please allow approximately 4-6 weeks for delivery of the Giveaway via U.S. Postal Mail. Velcro is not responsible for any incomplete, inaccurate or changes to Recipient's mailing address, or any late, misdirected, stolen, or lost U.S. Postal Mail sent to any Recipient.
Velcro reserves the right to substitute any portion of the Giveaway for an item of equal or greater value. No transfer, assignment, change of the Giveaway, or cash substitution is permitted. Other restrictions may apply. All applicable federal, state, and local taxes on the Giveaway are the sole responsibility of the Recipient. All other specifics regarding the Giveaway, not mentioned herein, shall be determined by Velcro, in its sole discretion. If an element of the Giveaway is unavailable for any reason, the remaining elements of the Giveaway shall constitute full satisfaction of Velcro’s obligation to Recipients; no further compensation will be awarded. ALL GIVEAWAYS ARE AWARDED "AS IS" AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), AND ALL SUCH WARRANTIES ARE HEREBY DISCLAIMED. In no event will the type and quantity of a Giveaway awarded exceed the number of Giveaways described in these Official Rules.
Velcro waives any and all liability whatsoever for failure to provide the Giveaway, or any part thereof, as well as for failure to comply with any provision of these Official Rules resulting from a force majeure event, including but not limited to due tropical storms, floods, fires, earthquake, unusually severe weather, hurricane, embargo, labor dispute or strikes (whether legal or illegal), labor or material shortage, equipment failure, transportation interruption of any kind, work slow-down, civil disturbance, lockouts, acts of God, terrorism, explosion, insurrection, war, government or quasi-governmental entity (whether or not the action(s), regulation(s), order(s), or request(s) prove to be invalid), or any other cause beyond Velcro’s reasonable control.
LIMITATION OF LIABILITY DISQUALIFICATION: All applicable federal, state, and local laws as well as regulations apply to this Promotion. Velcro, in its sole discretion, reserves the right to disqualify and prohibit from participating any Participant and/or Recipient, who Velcro determines (in its sole discretion) is or is attempting to: (i) tamper with Velcro's website, and/or any part of the Promotion and/or the Giveaway; (ii) attempting to undermine the legitimate operation of the Promotion by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten or harass any other participants Velcro's agents; and/or (iv) otherwise violating these Official Rules or the Terms of Use of Velcro's website. (b) ANY ATTEMPT TO DELIBERATELY DAMAGE VELCRO’S WEBSITE (OR ANY PART THEREOF) OR UNDERMINE THE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, VELCRO AND ITS LICENSEES (IF ANY) RESERVE THE RIGHT TO SEEK DAMAGES AND ANY OTHER AVAILABLE REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. EACH CONTESTANT (OR, IF THE CONTESTANT IS NOT OF AGE OF MAJORITY IN HIS/HER STATE OF RESIDENCE, THE LEGAL GUARDIANS THEREOF) AGREES TO INDEMNIFY AND HOLD HARMLESS VELCRO AND ITS AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES AND/OR LIABILITIES (INCLUDING REASONABLE ATTORNEYS' FEES AND EXPENSES) THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY OF THEM AT ANY TIME, IN CONNECTION WITH THE USE THEREOF, AND/OR BY CONTESTANT'S BREACHES OF ANY REPRESENTATION, WARRANTY OR COVENANTS ASSOCIATED WITH THIS CONTEST. If, in Velcro’s opinion, there is any suspected or actual evidence of fraud, electronic or non-electronic tampering or unauthorized intervention with any portion of this Promotion, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs) compromise the integrity of the Promotion, Velcro reserves the right to void the suspect Submission and/or suspend, modify or terminate the Promotion, subject to notification to the Regie. In the event of a dispute as to the identity of a participant based on an email address, the entry in question may be disqualified. Velcro is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online participant's ability to participate in the Promotion, and any injury or damage to participant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Promotion. Velcro further reserves the right to cancel, suspend, terminate or modify the Promotion if, in the sole discretion of Velcro, it is impossible or impractical to complete the Promotion as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, subject to notification to the Regie. In the event of termination of the Promotion by Velcro, Velcro reserves the right to award any prize(s) in a manner deemed fair and equitable by Velcro.
By participating in this Promotion, Participants agree that Velcro, and their respective subsidiaries and affiliates shall not be liable for any loss, damages, rights, claims, and actions of any kind in connection with the Promotion or resulting from Promotion participation, acceptance, possession, use, or misuse, of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, privacy or defamation. By accepting the prizes, Recipients agree for Recipients and Recipients' heirs, executors and administrators to release Velcro together with their respective directors, employees, officers, licensees, licensors and agents and any person associated with the production, judging, or administration of the Promotion from any and all liability, loss, or damage arising from or in connection with the awarding, receipt, and/or use or misuse of any prizes, or participation in any prize-related activities. Furthermore, by entering, Participants agree for Participant, Participant's heirs, executors and administrators: (i) to be bound by these Official Rules and the decisions of Velcro which shall be binding and final; (ii) to waive any right to claim ambiguity in the Promotion and/or these Official Rules, except where prohibited by law; and (iii) to hereby acknowledge that Velcro has neither made nor are in any manner liable or responsible for any representation, warranty, or guarantee, express or implied, in law or in fact, relative to prizes.
Velcro is not responsible for any typographical error in the printing of these Official Rules, administration of the Promotion, or in the announcement of the Giveaway.
USE OF PERSONAL INFORMATION, PUBLICITY: By participating in the Promotion, Velcro will be collecting personal data from Participants when he/she enters the Promotion, and from Recipients when he/she claims his/her prize. Personal data may include but is not limited to: name, address, e-mail address, as well as home and work telephone numbers. Please review Velcro’s privacy policy at www.velcro.com/privacy. By participating in this Promotion, Participant hereby agrees to all personal information uses and disclaimers as explained in the above noted privacy policy.
Notwithstanding the foregoing, by claiming his/her prize, where allowed by law, all Recipients grant Velcro exclusive permission to use their names, photographs, and likenesses for promoting the Promotion in any and all media now known or hereinafter invented without territorial or time limitations, as well as a publicly available winners list, and agree to waive any claims to compensation, royalty, right, or remuneration for such use.
RULES REQUEST, WINNERS LIST: For a copy of the Official Rules or a list of Recipients, where required by law, send a stamped, self-¬addressed envelope no later than ninety (90) days after the end date of the Promotion to: Velcro USA Inc. Attn: Marketing Department, c/o Giveaway,406 Brown Ave., Manchester, NH 03103, USA. Vermont residents only may omit return postage. All requests for a copy of the Official Rules and the names of winners must be received by December 31, 2014.
ARBITRATION. CHOICE OF LAW. JURISDICTION. Participants agree that (a): any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prize awarded, or the determination of the winner shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorney's fees; and (c) under no circumstances will Participants be permitted to obtain awards for, and Participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participants and Velcro in connection with this Promotion shall be governed by the laws of the State of New Hampshire, without regard for conflict of laws principles, and all proceedings shall take place in the federal, state or local courts in and for Hillsboro County, New Hampshire. If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination shall in no way affect the validity or enforceability of any other provision herein.
RESIDENTS OF QUEBEC. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
The Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Participant understands that he/she is providing his/her information to Velcro and not to Facebook. The information Participant provides will only be used in the manner described herein in the event Participant is selected as the Recipient or if Participant has indicated that he/she would like to receive additional information from Velcro.
