HE CONTEST
The Right Guard® BACK TO SCHOOL Contest runs from 10:00 a.m. Eastern Time ("ET") on August 28, 2014 to 11:59:59 p.m. ET on September 11, 2014, (the "Contest Period"). The Right Guard® BACK TO SCHOOL Contest (hereafter referred to as the "Contest") is a program which is sponsored by Henkel Consumer Goods Canada Inc. (the "Sponsor") and operated by BrandLink Inc. (the "Operator"), via Facebook. In voluntarily deciding to enter the Contest, you acknowledge that the Sponsor and Operator assume no contractual or legal responsibility to you and have specifically limited its legal obligations in its arrangements with the partners to whom it works with.
ELIGIBILITY
The Contest is open to all residents of Canada, who are eighteen (18) years of age or older at the time of entering the contest and is otherwise eligible under these Rules of the Contest (an "Entrant"), and is subject in all respects to the laws of Canada and its Provinces, Territories and Municipalities. Employees of the Sponsor (including members of each of their immediate families-parents, children, siblings, spouses, and grandparents, and their respective parents, children, siblings, spouses, grandparents), their respective parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, and any other parties engaged in the development, production or distribution of the Contest materials are excluded from entering. PLEASE DO NOT ENTER THE CONTEST IF YOU ARE INELIGIBLE.
HOW TO ENTER
NO PURCHASE NECESSARY. Visit and like the Right Guard® Facebook page at www.facebook.com/ rightguardcanada. Enter the required information on the entry form found in the Contest tab, agree to the Contest Rules and submit your entry. Limit: one (1) entry (an "Entry") per person. All entries must be received by 11:59:59 p.m. ET on September 11, 2014.
PRIZE
There are seventy-one (71) Prizes (the "Prizes") in total available to be won. There are seventy (70) secondary daily prizes comprising: Right Guard® Free Product Coupons valued at $ 4.00CDN each and one (1) grand prize comprising: A BEST BUY prepaid gift card valued at $500.00CDN The total combined value of all prizes is $ 780.00CDN.
The Prizes must be accepted as awarded without substitution and is non-transferable, non-refundable, may not be sold and must be accepted as awarded, without substitutions.
In the event the Sponsor is unable to award the Prizes as described for any reason, the Sponsor reserves the right to substitute the Prizes with another prize of equal or greater value, without liability, at its sole discretion
THE DRAW
Secondary Prizes:
From the period of August 28 to September 11, 2014, a random draw for five (5) secondary prizes will be held each day, in Toronto, Ontario at approximately 6PM EST from all eligible entries received (the "Entries").
An attempt to contact secondary prizewinners will be made by email within two (2) business days of each respective draw date. To be declared a Prize Winner, the selected entrant must correctly answer a mathematical skill-testing question, to be administered by email.
In the event that a selected entrant is disqualified from eligibility, does not correctly answer the mathematical skill testing question or cannot be contacted within two (2) business days after selection, the Operator will randomly select another entrant and the Sponsor shall be fully and completely released from any liability or responsibility to the first selected entrant. The above process will be repeated until seventy (70) entrants are confirmed as the Secondary Prize Winners. All Secondary Prize selected entrants remain eligible for the Grand Prize draw.
Grand Prize:
A random drawing of one (1) entrant from all eligible entries received during the Contest Period (the "Entries") will be held in Toronto, Ontario at approximately 10:00 a.m. ET on September 15, 2014.
The selected entrant will be contacted by e-mail within five (5) business days after selection. To be declared a Prize Winner, the selected entrant must correctly answer a mathematical skill-testing question, to be administered by email.

Odds of winning a prize will depend on the number of eligible Entries received during the Contest Period.
CONDITIONS OF ENTRY
By entering the Contest, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by the Official Rules and by the decisions of the Sponsor and the independent contest organization, made in their sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification. If a dispute arises regarding who submitted an Entry, the Entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
GENERAL CONDITIONS
All Contest Entries become the property of the Sponsor and no correspondence will be entered into except with the selected Entrant(s).
The Contest Program shall be governed by the laws of Ontario and the laws of Canada applicable therein, without giving effect to their conflict of laws principles. You expressly consent to the exclusive forum, jurisdiction, and venue of the courts of Ontario and/or the Federal Court of Canada in Ontario, in any and all actions, disputes, or controversies relating hereto.
For Residents of Quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des couses et des jeux in Quebec (the "Regie") for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
By voluntarily entering into the Contest electronically and providing your personal information, Entrants consent and agree to the Sponsors’ collection and use of the Entrant’s information for the administration of the Contest and agree to Sponsors’ use of Entrant information for the purpose of contacting Entrant in relation to the Contest. Entrants also consent to the use of their name, city of residence and image on videotape and/or photograph in any publicity carried out by the Sponsor with respect to the Contest, without further notice or compensation.
The Sponsor respects your right to privacy. If you do not voluntarily consent to receive other communications at time of entry, the information you provide will only be used to conduct the Contest and will be destroyed following the Contest. By voluntarily entering into the Contest, Entrants acknowledge they have read, are in compliance with, and agree to be bound by, these Program Rules and Regulations, including eligibility requirements. Entrants release and hold harmless the Sponsor, Operator, Facebook, their respective parent, related and affiliated companies, subsidiaries, members, dealers, advertisers, franchisees, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, artists, advisors, assignees, and all others associated with the development and execution of the Contest, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the Entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the Entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the Entrant of the prize awarded.
The Sponsor is not responsible for incorrect or inaccurate entry information which may affect a person’s ability to become an Entrant in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof which fail to fully comply with the Contest Rules and Regulations. No responsibility will be taken by the Sponsor for lost, delayed, mutilated or misdirected Entries or Declaration and Release Forms.
Subject to the jurisdiction of the Regie, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest without notice should any cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entrant information is subject to verification and Entries will be declared invalid if the Entrant information is forged, falsified, altered or tampered with in any way.
In addition, the Sponsor is under no obligation to continue the Contest and, with the consent of the Regie, reserves the right to suspend, modify or terminate this Contest at any time, for any reason, without any prior notice. The Sponsor also reserves the right, with the consent of the Regie, to amend or modify these Contest Rules at any time from here on forward, for as long as the Contest exists, without any prior notice, and the Sponsor assumes no liability to Entrants whatsoever for doing so.
Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook.
Laws: These are the official Contest Rules. This Contest is subject to all federal, provincial and municipal laws and regulations. These Contest Rules are subject to change, subject to the jurisdiction of the Regie, without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor.
LANGUAGE DISCREPANCY
In case of any discrepancy or inconsistency between the English version and the French version of these Official Rules or any Contest related materials, the English version shall prevail and apply. In case of any discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms of these Official Rules, these Official Rules shall prevail and apply. |
