NUTELLA Ultimate Breakfast Adventure Contest
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.
By participating in the NUTELLA Ultimate Breakfast Adventure Contest (the “Contest”), each entrant (or his or her parent or legal guardian if the entrant is under the age of majority in his or her province or territory of residence) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Ferrero Canada Inc. (“Sponsor”), which shall be final and binding in all respects. Sponsor is responsible for administration of the Contest. Entrants should look solely to Sponsor with any questions, comments or problems related to the Contest.
1. ELIGIBILITY: Contest is open only to legal residents of Canada who are 13 years of age or older at the time of entry. The Contest is open to all legal residents of Canada, who are at least thirteen (13) years of age in the province or territory in which they reside as of the first day of the Contest. If an entrant is under the age of majority in the province or territory they reside, the entrant’s parent or legal guardian must provide their consent for a) the minor to enter the Contest, b) the minor to authorize Facebook permissions that enable contest application c) allow for the Contest Sponsor to collect, use or disclose the minor’s personal information d) the minor to use their own Facebook account or the Facebook account of their respective parent or legal guardian to enter the contest. If a minor wins the Contest, the Grand Prize (as defined hereinafter) will be awarded to the parent and/or legal guardian of the minor. The Contest is subject to all applicable federal, provincial and municipal laws. Employees of Sponsor, Facebook, Inc. and their respective parent companies, affiliates, subsidiaries, related companies and agencies (collectively, the “Contest Entities”) and immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those with whom they are domiciled or living in the same household, whether or not related, are not eligible to enter or win.
2. TIMING: The Contest begins July 10, 2014 at 12:30:01 PM Eastern Standard Time (“EST”) and ends on February 27, 2015 at 5:00:01 PM Eastern Standard Time (“EST”) (the “Contest Period”).
3. HOW TO ENTER: (i) Grand prize draw: Internet access and a Facebook account are required to enter this Contest. To enter during the Contest Period, visit the NUTELLA Ultimate Breakfast Adventure Application (“Application”) at www.nutella.ca/breakfastadventure. Follow the on-screen instructions to accept the Application (which grants the Sponsor access to your email address and name) and follow the instructions on screen to create a NUTELLA breakfast creation to receive one (1) entry into the grand prize draw. Each time you create a unique combination of breakfast creations you will receive one (1) entry into the grand prize draw. Once you have registered for the Contest and are logged in with your Facebook account on the website, you can share the contest to Facebook via the Contest Application. You can obtain one (1) additional Grand Prize entry for each individual who signs up for the Contest via your unique referral URL. Entrants may access the Application and enter as often as they wish during the Contest Period. Odds of winning the grand prize depend upon the number of eligible entries received during the Contest Period.
(ii) Instant win secondary prizes: When an entrant submits a unique NUTELLA breakfast creation within the Application, he/she may also be eligible to win an instant win secondary prize. Entrants who are selected as eligible to receive an instant win secondary prize will be notified via an on-screen message that will appear within the Application. Instant win secondary prizes will be awarded no less than once per day (for purposes of this Contest, a “day” begins at 12:00:01 PM EDT/EST and ends at 11:59:59 AM EDT/EST with the exception of the last day of the Contest, where the “day” will end at 5:00:01 PM EST) by the Sponsor at times determined solely by the Sponsor throughout the Contest Period. Entrants who are notified via the Application that they have been selected to receive an instant win secondary prize must complete a mathematical skill-testing question and instant win form in order to be confirmed as a winner by the Sponsor. Odds of winning an instant win secondary prize on any day during the Contest Period depend upon the time and date of your entry and the number of eligible entries received each day. Entrants are only eligible to win one (1) instant win secondary prize during the Contest Period.
Entry must be made by an individual person; use of script, macro, or other automated systems to participate is prohibited and will result in disqualification. Submission of screen captures will not be accepted or considered by the Sponsor as proof of entry or of winning an instant win secondary prize. Entries will be deemed made by the authorized account holder of the Facebook account utilized at the time of entry. The “authorized account holder” is defined as the natural person who is assigned to a Facebook account by Facebook, Inc. Potential winners may be required to show proof of being the authorized account holder. If a prospective entrant is under the age of majority in his/her province or territory of residence, such entrant must have received permission from his/her parent/legal guardian in order to be eligible to enter and win a prize in the Contest.
ALL ENTRIES MUST BE RECEIVED BY 5:00:01 PM EST ON FEBRUARY 27, 2015. Sponsor and the Contest judges are not responsible for late, lost, misdirected, delayed or incomplete entries. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Inc. You are providing your information to Sponsor and not to Facebook, Inc. The information you provide will only be used for purposes of administering the Contest, and such other limited purposes as may be described in these Official Rules.
4. PRIZES: One (1) Grand Prize is available to be won, each consisting of a cheque for CDN $15,000. Two thousand (2,000) secondary instant win prizes are available to be won at the start of the Contest: One thousand (1,000) magnets (ARV - $1.00 each) and one thousand (1,000) coupons for a 375g jar of NUTELLA (ARV - $3.79 each). Only one (1) instant win secondary prize will be awarded per confirmed winning entrant. Please allow 8-10 weeks for prize delivery. Unclaimed instant win secondary prizes will not be awarded. With respect to the grand prize, Sponsor may disqualify a winner and randomly select an alternate winner if the grand prize is declined by the winner or returned as undeliverable. Prizes are non-transferable and not exchangeable for cash. Sponsor need not substitute a prize based on a winner’s request. Sponsor reserves the right in its sole discretion to substitute any prize, or component thereof, with a prize or component thereof of equivalent or greater value without notice. If any winner is under the age of majority in his/her province or territory of residence, the prize may be awarded in the name of winner’s parent or legal guardian who will be responsible for meeting all conditions of prize award including responding to the mathematical skill-testing question and completion and submission of the prize claim/release form.
5. GRAND PRIZE DRAW: A random draw to award the grand prizes will be conducted on March 10th, 2015. (the "Draw Date") at 1:00 PM Eastern Standard Time (EST) in Vancouver, British Columbia from among all eligible entries received during the Contest Period.
The grand prize selected entrants will be contacted within five (5) business days of the Draw Date via the email address associated with the selected entrant. If the selected entrants cannot be contacted within the time frame indicated above, his/her entry will be disqualified and another entrant will be randomly selected from the remaining eligible entries and the process above will be repeated until such time as contact is made with a selected entrant or there are no more eligible entrants. Prior to being declared a winner, the selected entrant must first correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question posed by mail or telephone at a mutually convenient time within ten (10) business days of the Draw Date. The selected entrant must also complete and return to the Sponsor within the time period indicated on the form an instant win prize claim/release form. In the event that the selected entrant declines the prize, incorrectly answers the mathematical skill-testing question, or fails to return the prize claim/release form within the time specified, he/she will be disqualified and another entrant will be randomly selected and the above process will be repeated until such time as the grand prize winner is confirmed or no more eligible entries are available.
6. PUBLICITY: Except where prohibited, participation in the Contest constitutes each entrant’s consent to Sponsor’s and its agent’s use of the entrant’s name, likeness, photograph, voice, opinions, town and province for promotional purposes in any media, worldwide, without further notice, payment or compensation.
7. GENERAL CONDITIONS: Selected entrants are subject to Sponsor’s verification. Sponsor’s decisions are final and binding in all matters related to the Contest. Selected entrants must comply with the Official Rules and receipt of prizes is contingent upon fulfilling all requirements. Sponsor is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit an entrant’s ability to participate in the Contest, even if caused by Sponsor’s negligence. Sponsor has the sole discretion, with the consent of the Régie des alcools, des courses et des jeux in Quebec, to modify, cancel or suspend this Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes incapable of running the Contest as planned. Sponsor is not responsible for changes to entrants’ contact information. Sponsor has the sole discretion to disqualify entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant.
8. RELEASE: As a condition of participating in the Contest, entrants release the Contest Entities from liability for loss, harm, damage, injury, cost or expense whatsoever including property damage, personal injury and death that may occur in connection with, preparation for, or participation in the Contest, or possession, acceptance or use of prizes or participation in any Contest-related activities and claims based on publicity rights, copyright or trade-mark infringement, defamation or invasion of privacy and merchandise delivery.
9. LIMITATION OF LIABILITY: Sponsor, Facebook, Inc. and their respective affiliates, subsidiaries, parent corporations, advertising and promotional agencies, and all of their officers, directors, shareholders, employees, and agents are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online system, computer equipment, servers, providers, or software, including any injury or damage to entrants’ or any other person’s computer relating to participation or inability to participate in the Contest; inability to access any website or upload information or data; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, or electronic malfunction or traffic congestion on telephone lines or the Internet or any website or for any other reason whatsoever; printing or other errors; or any combination thereof. Proof of uploading information or data or entering information is not considered proof of delivery or receipt. Illegible, duplicate and incomplete entries will be disqualified. False, fraudulent, or deceptive entries or acts shall render entrants ineligible and all associated entries will be void. If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, no more than the advertised number of prizes will be awarded.
10. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with this Contest shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein without giving effect to any choice of law or conflict of law rules. The parties hereto submit to the exclusive jurisdiction and venue of the courts in Toronto, Ontario and waive any claim that they are not subject personally to the jurisdiction of said courts or that any such suit or other proceeding is brought in an inconvenient forum or improper venue.
11. QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
